| This bill would, for each successive qualified fiscal year, as defined, beginning on or after July 1, 2006, modify ERAF reduction and transfer provisions by restricting the total amount of revenue allocated to a county's ERAF to the applicable revenue shift limit, as defined. This bill would require that those revenues that may not be allocated to the county's ERAF as a result of this limitation to instead be allocated among local agencies in the county in accordance with each local agency's proportionate share of those revenues that would be deposited in the county's ERAF in the absence of this bill. By imposing new duties upon local tax officials in the annual allocation of ad valorem property tax revenues, this bill would impose a state-mandated local program. | Existing law establishes the California Library Construction and Renovation Bond Act of 1988 and the California Reading and Literacy Improvement Construction and Renovation Bond Act of 2000. Existing law authorizes the issuance of bonds, pursuant to the State General Bond Law, in the amount of $75,000,000 in the 1988 act and in the amount of $350,000,000 in the 2000 act, for the purpose of financing library construction and renovation. This bill would enact the California Reading and Literacy Improvement and Public Library Construction and Renovation Bond Act of 2004, for submission to the voters at the 2004 direct primary election. If approved by the voters, this bill would authorize the issuance, pursuant to the State General Bond Law, of bonds in the amount not to exceed a total of $4,470,000,000 for the purpose of financing library construction and renovation and certain library services to youth pursuant to a program administered by the State Librarian. | Existing law specifies the various duties of the Judicial Council and the Administrative Office of the Courts, and provides for the establishment of county law libraries. This bill would require the Judicial Council to establish a task force on county law libraries, consisting of 3 representatives from the judicial branch of government selected by the Administrative Director of the Courts, 3 representatives of the counties selected by the California State Association of Counties, and 3 county law library administrators selected by the Council of California County Law Librarians. The bill would require the task force to identify the needs related to county law library operations and facilities, make recommendations for funding county law library operations, facility improvements, and expansion, and submit its report and recommendations to the Judicial Council and the Legislature on or before January 1, 2005. | ||||

| Under existing law regulating the administration of personal income taxes and corporation taxes, individual taxpayers are allowed to contribute amounts in excess of their tax liability for the support of specified funds or accounts. This bill would additionally allow taxpayers to designate on their tax returns that a specified amount in excess of their tax liability be transferred to the Public Library Book Fund, which would be created by this bill. This bill would, however, prohibit a voluntary contribution designation for this fund from being added on the tax return until another voluntary contribution designation is removed. | The Vehicle License Fee (VLF) Law establishes, in lieu of any ad valorem property tax upon vehicles, an annual license fee for any vehicle subject to registration in this state in the amount of 2% of the market value of that vehicle, as specified. The VLF Law offsets this amount by 67.5% for vehicle license fees with a final due date on or after July 1, 2001, and requires the Controller, upon receipt of monthly notification from the Department of Motor Vehicles of the amount of offsets applied, to transfer General Fund moneys to reimburse local governments for losses resulting from the vehicle license fee offset. This bill would provide that the Director of Finance is required to make the same determination of whether there are insufficient moneys in the General Fund for the Controller to fully reimburse local governments for losses resulting from the vehicle license fee offsets. | Existing provisions of the California Constitution prohibit the annual appropriations subject to limitation, as defined, of any entity of state or local government from exceeding its adjusted annual appropriations limit. These provisions also require 50% of the excess revenues received by the state in a fiscal year and the fiscal year immediately following it to be transferred and allocated, from a fund established for that purpose, to the State School Fund, and the remaining 50% of those excess revenues to be returned by a revision of tax rates or fee schedules within the next 2 subsequent fiscal years. This measure would repeal those provisions, and instead would limit total state General Fund and special fund expenditures to an annual increase of no more than the increase in the cost of living, as specified, multiplied by the percentage increase in state population. The measure would require excess revenues to be allocated in prescribed amounts to a reserve account, to the State School Fund, and to personal income taxpayers. | Existing law provides that it is a crime punishable by imprisonment in a county jail for a period not exceeding one year, a fine of up to $2,000, or both that imprisonment and fine to sell, distribute, or send harmful matter to a minor with knowledge that a person is a minor or after failing to exercise reasonable care in ascertaining the true age of a minor. Existing law provides that it is a defense in any prosecution for violation of this provisions if the material was distributed by use of telephones if payment was required by credit card before transmission of the matter. This bill would eliminate this defense. This bill would provide that reasonable measures to ascertain the age of a person shall not include reliance on possession of a credit card, debit card, bank card, or information therefrom, or upon an attestation by the person that they are at least 18 years of age. Various provisions of existing law, including, among others, the California Public Records Act, the Legislative Open Records Act, the Bagley-Keene Open Meeting Act, and the Ralph M. Brown Act, provide, with some exceptions, for public access to government records and meetings of government bodies. This measure would provide that the people have the right of access to information concerning the conduct of the people's business. It would provide that the meetings of public bodies and writings of public officials and agencies shall be open to public scrutiny .
